বুদ্ধিবৃত্তিক সম্পত্তি

বুকিং শর্তাবলী

Ghuddy has the right to change or modify these terms and conditions at any moment and without prior notice to be compliant with necessary regulations. You have accepted the changed terms and conditions if you continue to use the website and its services. Please examine the terms and conditions regularly to ensure you are aware of any changes.

General Disclaimer

Ghuddy does not possess any travel-related merchandise. We are just a link between consumers and travel service providers such as trip planners, hoteliers, and rental property owners, among others. Third-party travel suppliers sell travel goods on Ghuddy. The travel providers are responsible for their products, and before booking or purchasing their products through Ghuddy, you must understand and agree to the terms and conditions of the third-party travel providers.

Please be aware, Ghuddy does not own any travel service providers. We believe in providing our users with quality services and therefore provide on-spot and online consumer complaint handling services with third-party service providers in order to make sure consumer satisfaction is held first always. However, the consumer service policy only will work as an aid to consumer support, not as a liable medium of responsibility among both user parties. Ghuddy cannot be held accountable if something goes wrong during the booking or trip period, and you must handle your problem directly with the travel operator in question.

User Account: To access our services, you need to create an account. When registering for the services and at all other times when using them, you are required to give accurate, up-to-date, and full information. You are also required to keep this information up-to-date. Any account you set up using the services has just you as its single authorized user. All actions taken using your account or password are exclusively your responsibility. You acknowledge that it is your duty to keep an eye on your account and you agree to take full responsibility for any unauthorized use of your password or account. If you have any reason to believe that somebody else is using your password or account without your permission, please contact our consumer care team right away. Regardless of whether you let us know that someone else was using your account without your permission, Ghuddy won't be responsible for any losses, damages, liabilities, costs, or fees incurred by Ghuddy or a third party as a result. Ghuddy reserves the right to suspend or terminate your account and refuse all current or future use of the Services if you provide any information that is untrue, inaccurate, not current, or incomplete, or if Ghuddy has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete (or any portion thereof). To utilize Ghuddy's services, we could allow you to use just one set of login information or demand it. If Ghuddy has already revoked your account or barred you from using the Services, you agree not to register an account or use the Services.

Agent Communication: To access our services and to make sure you get accurate results. You are agreeing to accept a direct communication medium between our Ghuddy agent and you which will be conducted via a call, email, and other communication mediums. You are also agreeing and giving your consent to Ghuddy to have the authority to record the conversion between you and the Ghuddy agent for future references for keeping records and using them as grounds for solving service-related issues and customer disputes. You are also agreeing that Ghuddy holds the right to ban/delete/block any registered or unregistered direct booking user, based on founding proof of misbehaving /giving fraudulent information/ using foul language towards the Ghuddy agent. Ghuddy also promises to provide best-in-class customer service and trained agents to its users for making sure both parties have the best satisfaction.

Intellectual Property

Whether registered or unregistered, all trademarks, logos, images, and service marks, as well as these Terms as they appear on the Platforms or in our marketing materials, are the exclusive property of Ghuddy and/or other parties who have permitted us to use their works (collectively the "Trademarks"). Without our prior express written approval, you are not permitted to use, copy, reproduce, republish, upload, post, transmit, distribute, or alter our Trademarks in any way. Ghuddy's trademarks may not be used on any other website without our prior written consent. The greatest extent of the law, including criminal prosecution, will be used by Ghuddy to zealously maintain its intellectual property rights. Ghuddy neither warrants nor represents that your use of materials displayed on the Platforms will not infringe the rights of third parties not owned by or affiliated with Ghuddy. You use all content on the Platforms at your own risk.

Booking Terms

When you book travel products using our website, you are booking with the travel provider listed on the booking page, and our website solely serves as a user interface. As a result, Ghuddy will take responsibility for the consumer in terms of offering quality authorized hotels, after-booking, and consumer service throughout the consumer's stay at the hotel, as well as providing on-site physical support for the booking but Ghuddy will not be liable if the travel providers suddenly deter from their commitment and services quality nor if they provide Ghuddy with fraudulent information and sudden changes to their services without prior notice to Ghuddy Management Team. Ghuddy has no role in developing the travel product's description, determining the price and any fees, or providing the travel products that you book.

You agree to address and resolve any issues or disputes you have with your booking and/or the Travel Product with the Travel Provider, which you can do through Ghuddy’s consumer service or Complaint Portal that Ghuddy provides in form of aid to consumer support and complaints handling policy with the travel provider.

Promotion Terms

From time to time, Ghuddy generates promotion codes/ discounts that can be used on the site.

Ghuddy retains the right, without prior notice, to add, alter, modify, or withdraw all or any of the Terms and Conditions, or to replace, fully or in part, the program with any other program, whether similar to or not, or to withdraw it entirely.

In the event of a disagreement with any party, Ghuddy is authorized to make the final decision. When you register with Ghuddy.com, you agree that we or any of our partners, affiliates, or group companies may contact you from time to time with offers/ information about products/ services that we believe may be of interest to you.

Payment Terms

By using this site to make a payment, you consent to the use of your personal information for transaction verification and validation, ensuring that no one else uses your credentials without your permission. You must also agree that the information you supply may be shared with third-party credit card payment gateway companies for verification purposes. Your personal information will be used solely for the purpose of verifying and confirming your identification.

You consent to abide by these Payments Terms by using the Payments Services. To perform maintenance procedures that guarantee the proper operation of the Payment Services, Ghuddy Payments may temporarily limit or stop your access to or use of the Payment Services, or its features. Ghuddy Payments occasionally introduces new payment services while also enhancing, modifying, and improving the existing payment services.

Links to third-party websites or resources (referred to as "Third-Party Services") may be found in the Payment Services. Ghuddy Users should carefully read the terms of service and privacy policies that apply to such Third-Party Services. The use of such Third-Party Services is not the responsibility or liability of Ghuddy Payments.

Bill Calculation: & Ghuddy calculates the bill based on various factors such as (“Discounts”, “Time Frame”, “Special Promotions”, “Promotional Offers”, “Day, Month, Year, Season wise offers” etc) from time to time. If you use Ghuddy services you are hereby agreeing to these bill calculation changes and in order to confirm and avail of Ghuddy services, you agree to pay the amount that will be calculated based on these factors.

Discounts are subject to change and Ghuddy reserves the right to change the discounts on its services from time to time, Ghuddy discounts may appear different on different days and times, locations, properties, etc and they can be based on Ghuddys promotional campaigns or offers, given by Ghuddy.

Cancellation & Refund

This Policy applies to all reservations made on or after the effective Date. When this policy applies, it controls and takes precedence over the reservation’s cancellation policy. Before submitting a request for a refund, whenever feasible, the guest must notify Ghuddy Support directly or with Hotel Management to resolve the Experience Issue directly with the respective Hotel in question but be assured Ghuddy will always ensure its consumer's satisfaction. In connection with resolving the issue, Ghuddy consumers can request refunds directly from the website or by contacting Ghuddy support. We may reduce the amount of any refund based on the conditions that were given to consumers at the time of booking.

In general Ghuddy cancellation policy follows a 72-hour rule, where the customer can initiate a cancellation request on their booking (“if the booking allows cancellation”) - some bookings may not be subject to cancellation as per promotional or campaign requirements, and users are advised to check thoroughly before making the booking for cancellation availability on the selected booking property. Ghuddys refund policy states that if a successful refund request is initiated, Ghuddy will carry out the refund process which in general will take about 72 hours from the refund request initiation and may take up to 7 days or more based on the refund - (“amount”, “bank request initialization”, “technical distributions” etc).

 Submitting a fraudulent report violates our Terms of Service and may result in account termination with all account rewards programs or points and this can be subject to zero refund as well. Our decisions under this Policy are binding but do not affect other contractual or statutory rights that may be available. Any right that the Merchant may have to initiate legal action remains unaffected. All rights and obligations under this Policy are within Ghuddy, its consumer, and Ghuddy Merchant only. Any changes to this Policy will be made following our Terms of Service. In case of national emergency/ lockdown/ political unrest/ natural disaster etc., a standard refund policy may not be applicable.

Product Delivery Time

Ghuddy delivers its products in the form of services. The general estimated delivery time for delivery of Ghuddy’s products ranges from 1 hour to approximately 7 days or more depending on the type of booking the user has made and according to various scenarios. Ghuddy provides three types of booking methods for its consumers as follows:

Express Booking : The consumer selects their hotel from our website according to their preferences and after successful payment completion, Marchants are notified of the booking after the merchant's room confirmation, Within an hour, the customer should receive an email with a coupon, and a confirmation of their reservation, along with check-in information.

Non-Express Booking : The consumer's booking is after payment is put on hold and the accommodation provider (“Marchant”) is contacted via Ghuddy agent to confirm the consumer's booking after Marchant confirmation the consumer is given confirmation mail along with other details.

Direct Booking : The consumer can submit their request for direct booking assistance from Ghuddy, where Ghuddy after the request submission, Ghuddy agents work on the booking request, and helps the consumer each step of the way by providing various hotel-related information and recommendations after the consumer selects their preference from the list provided and complete the payment, Ghuddy agents work to confirm the room with Hotel Management team and after confirmation, the consumer is given confirmation mail along with other details. If you agree to use any services provided by Ghuddy you agree to these delivery terms and their required time according to the policy mentioned. Ghuddy also reserves the right to change any of this booking duration without prior notice and may also terminate the booking completely if faced with difficult scenarios.

Additional Terms:

By accepting the terms and conditions the consumer acknowledges and agrees that Ghuddy.com may call the mobile phone number/or email provided by the consumer while registering for the service or to any such number/address replaced and informed by the consumer, for the purpose of collecting feedback from them regarding their travel, reservation experiences, facilities and/or services of the merchant.

By using the Services, you agree to be bound by this Agreement and acknowledge and agree to the collection, use, and disclosure of your personal information in accordance with Ghuddy’s privacy policy which is incorporated in this Agreement by reference. You also agree to abide by any additional ghuddy’s policies for Users that are published on our website or mobile application. Certain features of our Services may be subject to additional terms and conditions, which are incorporated herein by reference.

Dispute resolution:

All the disputes and relevant issues will be solved by Bangladeshi law and the shortest way will be adopted if needed. Arbitrator Powers To the fullest extent permissible by law, Bangladeshi law shall govern and be followed in the interpretation of these terms and conditions and the performance of our services.

You agree that any disagreement or claim relating to the website, any services or goods rendered, or any statements made by us will be settled amicably, first and foremost with ghuddy Limited. You further acknowledge that in the case that you have contacted us and have had a discussion with ghuddy Limited, and we have not satisfactorily addressed your claims within 90 days, you may refer the matter to arbitration, and all such claims shall be determined by binding arbitration. All disputes relating to these general terms and conditions and our services must be brought exclusively to Bangladesh’s court system in Dhaka.

The Software and Services may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications. Except as outlined in Ghuddy’s Privacy Policy or as otherwise required by applicable law, Ghuddy is not responsible for any delays, reservation failures, loss, or injury resulting from such problems.
